West Virginia v. B.P.J. (24-43)
- Term
- OT 2025
- Argued
- 2026-01-13
Question Presented
(1) Whether Title IX prevents a State from designating girls' and boys' sports teams based on biological sex; and (2) whether the Equal Protection Clause prevents a State from offering separate boys' and girls' sports teams based on biological sex. (West Virginia's Save Women's Sports Act; the Fourth Circuit ruled for B.P.J. on Title IX and vacated the judgment for the State on equal protection. Companion to Little v. Hecox, No. 24-38, on the same EP question; this case adds the Title IX claim and is the clean merits vehicle.)
Model prediction
West Virginia 6-3 (89% confidence).
